Can I collect unemployment and work self employment (1099) at the same time?

I was working for a company for over a year as a W2 employee. I am currently collecting unemployment benefits in California but now i am working self employment as well. Since my contractor position say i am not an employee and I cannot collect unemployment from this position I believe I can still collect my unemployment checks. Considering this is residual income and not actual work, i do not think i am lying on my unemployment forms. Am I correct? Anyone else in a similar situation?

  2. ~~Bottom line is in California you must report any and all income on the form that comes with your UI check. It is income you are bringing in, so if you do not submit it, it is considered fraudulent.~~

  3. No, that’s fraud. To collect unemployment, you have to be available to work full time.

    The form will ask, are you available for work full time. The answer is no, because you’re at this contract job. Sorry.

  4. You are LYING. You are CHEATING the system.

    Any INCOME is INCOME… Although that doesn’t mean you won’t get any unemployment, it would definitely change it (lower it).

    If you are going to receive a 1099 for this work, then you probably will get caught. At the very least, you will have to pay it back. At the very most, you will spend some time in jail.
